Agreement
These Terms of Service ("Terms") are a legal agreement between you and One and Three("we," "us," or "our"). By accessing https://www.oneandthree.in, downloading Retro Messenger, or using any application published by One and Three, you agree to these Terms. If you do not agree, do not use our services.
These Terms are organized in two parts: terms that apply to our website, followed by terms that apply specifically to Retro Messenger. Where app-specific terms apply, they govern your use of the app.
Scope
These Terms apply to https://www.oneandthree.in and to Retro Messengerfor iOS. They do not govern third-party services you access through our apps (such as Google Sign-In), which are subject to those providers' own terms and policies.
Website: Our Services
One and Three provides a marketing website with information about our studio and applications, including portfolio pages, an about page, and a contact form. The website is provided for informational purposes. We may update, suspend, or discontinue any part of the website at any time.
Website: Intellectual Property
All content on this website, including text, graphics, logos, and design, is owned by One and Three or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without written permission.
Website: Acceptable Use
When using our website, you agree not to:
- Use the website for unlawful purposes
- Attempt to gain unauthorized access to our systems or networks
- Interfere with the proper functioning or security of the website
- Transmit malware, spam, or harmful code through our contact channels
Website: Disclaimer
Our website is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the website will be uninterrupted, error-free, or free of harmful components.
Website: Limitation of Liability
To the maximum extent permitted by law, One and Three shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our website.
Digital Subscription Services
Some services offered by One and Three may be paid digital subscription services delivered through Telegram, messaging platforms, websites, or related digital workflows. Access terms, pricing, duration, and activation requirements for such services will be disclosed at the time of purchase or onboarding. By purchasing or using such services, you agree to comply with the applicable service instructions, activation steps, and support procedures communicated by One and Three.
Refunds, cancellations, renewals, and access periods for such services are governed by our Refund & Cancellation Policy and any service-specific details presented at checkout.
Retro Messenger: Eligibility
You must be at least 13 years of age (or the minimum age required to use online services in your jurisdiction) to create an account and use Retro Messenger. By using the app, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
Retro Messenger is not directed to children under 13. If you are under the age of majority in your jurisdiction, you may use the app only with the consent and supervision of a parent or legal guardian.
Retro Messenger: Accounts and Authentication
To use Retro Messenger, you must create an account using an email address and password or by signing in with Google. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You agree to provide accurate account information, keep your profile information current, and notify us promptly at support@oneandthree.in if you suspect unauthorized access to your account.
Email-based accounts require email verification before you can access the app. You may change your password from within the app. Password reset is available for eligible email accounts.
You may sign out of the app on any device. To permanently delete your account and associated cloud data, go to Settings → Security → Delete account in the app, confirm the action, and re-authenticate. If you cannot access the app, you may email support@oneandthree.in with the subject line "Account Deletion Request" from your registered email address. See our Privacy Policy for details on what is deleted.
Retro Messenger: The Service
Retro Messenger is a text messaging application that supports one-to-one and group conversations, message requests, friend connections, read receipts, typing indicators, push notifications, and optional end-to-end encryption for message bodies. The app currently supports text-only messaging and does not support media attachments, voice messages, or in-app purchases.
We may modify, suspend, or discontinue any feature of Retro Messenger at any time. We do not guarantee uninterrupted availability of the service.
Retro Messenger: User Content and Messaging
"User Content" means any text, usernames, display names, group names, message-request introduction notes, and other material you submit through Retro Messenger.
You retain ownership of your User Content. By submitting User Content, you grant One and Three a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process your User Content solely as necessary to operate, provide, and improve Retro Messenger, including delivering messages to recipients, generating short plaintext previews for inbox and notification display, and enforcing these Terms.
You are solely responsible for your User Content and for your interactions with other users. We do not endorse User Content and are not obligated to monitor conversations. You acknowledge that messages you send may be read by intended recipients and that recipients may copy, forward, or export conversations.
Message requests require a short introduction note before another user can accept your connection request. Group conversations may include up to 20 participants.
Retro Messenger: Encryption and Recovery
Retro Messenger encrypts message bodies using end-to-end encryption. However, certain data, such as short message previews, message-request introduction notes, group names, and conversation metadata, is stored in plaintext on our servers, as described in our Privacy Policy.
You may create a recovery passphrase to back up your encryption keys. You are solely responsible for safeguarding your recovery passphrase. If you lose your device and recovery passphrase, your encrypted message history may be permanently unrecoverable. We cannot restore lost passphrases or decrypt messages without them.
Signing out of the app does not delete encryption keys stored in your device's Keychain. Deleting the app from your device may remove locally stored keys and data.
Retro Messenger: Acceptable Use
When using Retro Messenger, you agree not to:
- Violate any applicable law or regulation
- Harass, threaten, abuse, defame, or harm another person
- Send spam, unsolicited messages, or bulk automated messages
- Distribute content that is illegal, sexually exploitative of minors, hateful, fraudulent, or that infringes another person's intellectual property or privacy rights
- Impersonate another person or misrepresent your affiliation
- Attempt to access another user's account, encryption keys, or private data without authorization
- Reverse engineer, decompile, or attempt to extract source code from the app except as permitted by law
- Interfere with or disrupt the service, servers, or networks connected to the service
- Use the service to transmit malware or to probe, scan, or test vulnerabilities
- Circumvent security features, blocks, or access controls
We may investigate violations and take action including removing content, suspending or terminating accounts, and reporting activity to law enforcement where appropriate.
Retro Messenger: Blocking and Safety
You may block other users from within a conversation or from Settings. When you block a user, they cannot send you new messages or message requests, and push notifications from blocked users are suppressed.
You may report another user from a direct-message chat menu or from a group member list. Reporting opens a pre-filled email to support@oneandthree.in with context we need to investigate (such as usernames and conversation identifiers). You can also email us directly about abusive content or behavior that violates these Terms or applicable law. In an emergency, contact your local authorities.
We are not responsible for the conduct of any user. You use Retro Messenger at your own risk and should exercise caution when communicating with people you do not know.
Retro Messenger: Termination
You may stop using Retro Messenger at any time by signing out and deleting the app from your device, or by deleting your account in Settings → Security → Delete account (or by email if you cannot access the app), as described above.
We may suspend or terminate your access to Retro Messenger at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a risk to other users or the service, or if required by law. Upon termination, your right to use the app ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and dispute provisions) will survive.
Retro Messenger: Third-Party Services
Retro Messengerrelies on third-party services including Google Firebase (authentication, database, cloud functions, and push messaging) and Google Sign-In. Your use of those services may be subject to Google's terms and privacy policy. Apple Push Notification service is used to deliver notifications to your device.
We are not responsible for third-party services, their availability, or their practices. Links to our website or third-party services do not constitute endorsement.
Retro Messenger: Disclaimers
Retro Messengeris provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the app will be uninterrupted, secure, or error-free, that messages will be delivered without delay, that encryption will prevent all unauthorized access, or that defects will be corrected. You are responsible for maintaining appropriate backups of information you wish to preserve, including using the in-app chat export feature where available.
Retro Messenger: Limitation of Liability
To the maximum extent permitted by applicable law, One and Three and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of or inability to use Retro Messenger.
To the maximum extent permitted by applicable law, our total liability for any claim arising from or related to Retro Messenger shall not exceed the greater of (a) the amount you paid us for the app in the twelve months preceding the claim, or (b) one hundred U.S. dollars (USD $100). Because the app is currently offered at no charge, this limit is USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
Apple App Store Terms
If you downloaded Retro Messenger from the Apple App Store, the following additional terms apply:
- These Terms are between you and One and Three, not Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app. Any support requests should be directed to support@oneandthree.in.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, failure to conform to legal requirements, or consumer-protection claims.
- In the event of a third-party claim that the app infringes intellectual property rights, One and Three, not Apple, is responsible for investigation, defense, settlement, and discharge of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
- You must comply with applicable App Store terms of service when using the app.
Changes
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes to Retro Messenger, we may notify you in the app or by email where appropriate. Continued use of our services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using our services.
Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in India, unless applicable consumer-protection law in your jurisdiction requires otherwise.
